NOTICE OF HOMEOWNERS ASSOCIATION LIEN FORECLOSURE
WHEREAS, default having been made in payment of the homeowners association assessments of The Shires Homeowners’ Association, Inc., by John M. Clark and Jacqueline S. Clark, Husband and Wife, the owners of the following described property, the undersigned, The Shires Homeowners’ Association, Inc., an Alabama non-profit corporation, D/B/A The Shires (the “Association”), under and by virtue of the enforcement provisions with respect to the lien of the Association, and the verified claim of lien filed for record in Instrument Number 20170614000209680, 20180612000208040, 20200714000291750 and 2022060100220260 in the Probate Office of Shelby County, Alabama, and set forth in the Declaration of Covenants, Conditions, and Restrictions as recorded in Instrument Number , Book 173, Page 840, Book 035, Page 456, Instrument Number 20110819000246330 and as amended in the Probate Office of Shelby County, Alabama, will sell at public outcry for cash at the main entrance of the Courthouse at Shelby County, Columbiana, Alabama, on February 20, 2026, during the legal hours of sale, the following described real estate situated in Shelby County, Alabama, to wit:
Lot 17, The Shires Subdivision, according to the Plat of Phase II of the Shires, as recorded in Map Book 13, Page 86, in the Office of Shelby County, Alabama.

THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE (IF ANY) AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
This foreclosure sale has been continued. It will be held on February 20, 2026, at the Shelby County Courthouse in Columbiana, Alabama. The sale was originally set for February 4, 2026.
Said sale is made for the purpose of foreclosing said continuing Lien, paying the Lien debt, the costs and expenses of foreclosure, including a reasonable attorney’s fee as allowed and permitted by the Declaration. Lienholder/Association reserves the right to bid on the subject property. Said sale is also subject to unpaid taxes or assessments whether of record or not.
