PUBLIC NOTICE

ORDINANCE 26-265

SUMMARY: AN ORDINANCE REPEALING AND REPLACING SECTIONS 34-11 RELATING TO GARBAGE FEES AND CLARIFYING CPI-U ADJUSTMENT
WHEREAS, the existing provisions in Section 34-9 previously imposed an annual increase based upon the Consumer Price Index for All Urban Consumers, and
WHEREAS, clarifying that CPI will ensure sufficient revenue to fund ongoing operations, maintenance, debt service (if applicable), and future capital improvements to the garbage system; and
WHEREAS, the City Council finds that this change is necessary to protect public health, maintain reliable garbage service, and promote the continued growth and prosperity of the City of Alabaster;
NOW, THREFORE, THE PUBLIC GOOD REQUIRING IT, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALABASTER, ALABAMA AS FOLLOWS:
Section 1 - REPEAL AND REPLACEMENT
Sections 34-9 is hereby REPEALED and replaced as follows:
Sec. 34-9. Collection; fees.
(a) The city, acting by and through its own employees or by contract with third parties, shall collect, haul and dispose of garbage, rubbish and other refuse in the city at least once a week, and the charges herein prescribed are based on such periodic collections and disposals.
(b) The fees for such collection shall be paid monthly in advance. As of January 1, 2026, the fee shall be $20.00 for residential customers (for one cart) plus one-half the residential rate for each additional cart, and $40.03 for business or other non-residential customers (for the first two carts) plus an additional one-half the business rate for each additional cart. No business or non-residential customers shall have more than four carts. The fee shall be adjusted annually on October 1 utilizing the Bureau of Labor Statistics Consumer Price Index for All Urban Consumers: Water and Sewer and Trash Collection Services. The fee shall be collected for each single-family residence or mobile home not in a mobile home park, and multifamily residences, and each business or other non-residential establishment that is not otherwise serviced by a dumpster. Mobile home parks and apartment complexes shall be serviced by dumpsters or other acceptable means that are not serviced by the city.
(c) Each location in the city shall be serviced by a separate account. Each account holder shall pay a service fee of $75.00 in advance by the person responsible for the payment of each single- family residence or mobile home, each housekeeping unit in apartment buildings and multifamily residences, and each business or other nonresidential establishment, that hereinafter becomes subject to the provisions hereof, prior to garbage services being provided by the city. The persons or entities who qualify, as amended, under section 34-13 shall be exempt from the payment hereof. In addition, the said service fee shall not be charged to any account holder, whether person or entity, that is transferring their account to a new location within the city. This exemption applies individually to an account holder per location and is not to be misconstrued to allow for waiving of the setup fee to an entity engaged in rental services.
(d) This service fee is not a deposit, but is necessary for the services to be rendered, including the costs of depreciation and replacement of equipment, capital improvements, administrative fees, costs of providing services and otherwise.
Section 2. EFFECTIVE DATE
This Ordinance shall be effective upon its passage and publication as required by law.
