AN ORDINANCE REZONING PROPERTY FROM RMH TO M-2

WHEREAS, the City of Columbiana has adopted a comprehensive zoning ordinance; and

WHEREAS, certain property located off Industrial Parkway, Columbiana, AL is currently owned by Digihost Technology, Inc; and

WHEREAS, after holding a public hearing on the matter, the Columbiana Planning and Zoning Commission has recommended that, at the request of the City of Columbiana, a portion of this parcel be rezoned from RMH to M-2; and

WHEREAS, the Columbiana City Council has held a public hearing on the Columbiana Planning and Zoning Commission’s recommendation and carefully considered the said recommendation and the comments thereon;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF COLUMBIANA, ALABAMA, AS FOLLOWS:

Section 1. That the zoning district boundaries be amended so as to rezone a portion of the following property from RMH to M-2, and that such rezoning be reflected on the Zoning Map of the City of Columbiana:

Tax Parcel # 21 6 23 3 001 033.000 (See legal description below for the portion to be rezoned)

SW¼ of SW¼, Section 23, Township 21 South, Range 1 West — Shelby County, Alabama

A tract of land lying in the southwest quarter of the southwest quarter, Section 23, Township 21 South, Range 1 West, and being a part of Shelby County tax parcel number 21-6-23-3-001-033.0000 and a part of Parcel II recorded in Instrument # 20220621000247630 in the Probate Office of Shelby County, Alabama, and being more accurately described as follows:

Commence at a found 2” iron pipe at the Southwest corner of Section 23, Township 21 South, Range 1 West, Shelby County, Alabama; Thence run north 89 degrees 55 minutes 55 seconds east for 349.47 feet to a found 3” capped pipe; Thence run north 89 degrees 35 minutes 00 seconds east for 335.97 feet to a found iron (capped # 29990) at the southwest corner of said tax parcel and the point of beginning;

Thence run north 00 degrees 22 minutes 53 seconds east for 763.51 feet along the west line of said parcel to the centerline of an unnamed stream; Thence run along said stream centerline the following courses: south 50 degrees 23 minutes 38 seconds east for 40.55 feet; south 76 degrees 10 minutes 23 seconds east for 19.90 feet; south 29 degrees 54 minutes 43 seconds east for 12.92 feet; south 09 degrees 36 minutes 42 seconds east for 109.03 feet; south 33 degrees 42 minutes 41 seconds east for 13.88 feet; south 78 degrees 39 minutes 05 seconds east for 37.60 feet; south 15 degrees 50 minutes 10 seconds east for 52.39 feet; south 89 degrees 34 minutes 53 seconds east for 38.06 feet; south 68 degrees 50 minutes 05 seconds east for 33.30 feet; south 84 degrees 23 minutes 05 seconds east for 51.45 feet; south 58 degrees 55 minutes 41 seconds east for 22.21 feet; south 23 degrees 36 minutes 06 seconds east for 21.67 feet; south 43 degrees 39 minutes 28 seconds east for 49.85 feet; Thence leaving said stream centerline, run south 89 degrees 49 minutes 44 seconds east for 22.75 feet to a found 1” square bar on the easterly boundary of said tax parcel; Thence run along said easterly boundary the following courses: south 69 degrees 46 minutes 24 seconds east for 152.91 feet to a found 1” square bar; south 00 degrees 24 minutes 52 seconds west for 210.13 feet to a found iron (5/8” rebar); Thence north 89 degrees 35 minutes 14 seconds west for 104.08 feet to a found railroad spike; south 00 degrees 31 minutes 46 seconds west for 200.59 feet to the southeast corner of said tax parcel; Thence run north 89 degrees 34 minutes 56 seconds west for 380.39 feet to the point of beginning.

Said tract of land containing 5.48 acres, more or less.

Provided, however, that such rezoning is subject to the following condition: Compliance with the rules, regulations, policies, and procedures of the City of Columbiana, and

Section. 2. That the city clerk be directed to publish or post this ordinance as required by law.

This ordinance was adopted and passed by the City Council of the City of Columbiana, Alabama, this the 15th day of September, 2026.
